Scope of the GTC

The content of the contract concluded between us is determined – in addition to the provisions of the applicable mandatory legislation – by these General Terms and Conditions (hereinafter: GTC). Accordingly, these GTC set out the rights and obligations of you and of us, the conditions for the conclusion of the contract, the performance deadlines, the delivery and payment terms, the rules on liability, and the conditions for exercising the right of withdrawal.

Technical information required for the use of the Website that is not contained in these GTC is provided by other information available on the Website.

Language and form of the contract

The language of the contracts falling within the scope of these GTC is Hungarian.

The contracts falling within the scope of these GTC do not qualify as written contracts and are not filed by the Seller.

E-invoice

Our company issues electronic invoices in accordance with Section 175 of Act CXXVII of 2007. By accepting these GTC, you consent to the use of electronic invoices.

Prices

Prices are stated in HUF and include 27% VAT. The possibility that the Seller may change prices for business policy reasons cannot be excluded. Price changes do not apply to contracts already concluded. If the Seller has displayed a price incorrectly and an order has been received for the Goods, but the Parties have not yet concluded a contract, the Seller shall proceed in accordance with the “Procedure in the event of an incorrect price” section of the GTC.

Procedure in the event of an incorrect price

The following qualify as obviously incorrectly displayed prices:

  • a price of HUF 0,

  • a discounted price displayed incorrectly in relation to the correct discount percentage shown next to the correct original price (e.g. for Goods priced at HUF 1,000, with a 20% discount displayed, Goods offered incorrectly for HUF 500 on the basis of an erroneous calculation not reduced in line with the percentage, instead of the correct HUF 800).

Where such an incorrect price is displayed, the Seller shall offer the possibility of purchasing the Goods at the actual price; in possession of this information, the Buyer may decide whether to order the Goods at the actual price or not to take up this possibility, in which case no contract is concluded between the Parties.

The Consumer may submit claims under the warranty for material defects (kellékszavatosság), the product warranty (termékszavatosság) or the guarantee (jótállás) relating to the Goods, or an objection aimed at remedying an individual infringement of rights or interests concerning the conduct, activity or omission of the Seller, or of a person acting on behalf of or for the benefit of the Seller, directly connected with the distribution or sale of goods to consumers (a consumer complaint within the meaning of the Consumer Protection Act (Fgytv.)), via the following contact details and methods:

  • In person, orally, at the following address: 2040 Budaörs, Gyár utca 2

  • Customer service opening hours:

  • Monday: 09:00-17:00

  • Tuesday: 09:00-17:00

  • Wednesday: 09:00-17:00

  • Thursday: 09:00-17:00

  • Friday: 09:00-17:00

  • Saturday: closed

  • Sunday: closed

  • In writing, via the following website: https://woopla.eu

  • In writing, via the following e-mail address: [email protected]

  • In writing, by post: 2040 Budaörs Gyár utca 2

The Seller is obliged to handle the Consumer’s claims under the warranty for material defects (kellékszavatosság), the product warranty (termékszavatosság) or the guarantee (jótállás) not in accordance with the rules of the Consumer Protection Act (Fgytv.) on the handling of consumer complaints, but in accordance with separate legislation.

The Consumer may communicate to the Business, orally or in writing, a complaint under the Consumer Protection Act (Fgytv.), being an objection aimed at remedying an individual infringement of rights or interests concerning the conduct, activity or omission of the Business, or of a person acting on behalf of or for the benefit of the Business, directly connected with the distribution or sale of goods to consumers – with the exception of claims under the warranty for material defects (kellékszavatosság), the product warranty (termékszavatosság) or the guarantee (jótállás).

The Seller shall examine an oral complaint immediately and remedy it as necessary. If the Consumer does not agree with the handling of the complaint, or if immediate investigation of the complaint is not possible, the Seller shall without delay draw up a record of the complaint and of its position in relation thereto, and shall hand over a copy of the record to the Consumer on the spot in the case of an oral complaint made in person, or, in the case of an oral complaint made by telephone or by means of another electronic communications service, shall send it to the Consumer at the latest within 30 days – in accordance with the requirements applicable to replies to written complaints – together with the substantive reply. The record of the complaint must contain the following:

a. the Consumer’s name, address or e-mail address,

b. the place, time and manner in which the complaint was submitted,

c. a detailed description of the Consumer’s complaint, and a list of the papers, documents and other evidence presented by the Consumer,

d. the statement of the Business on its position regarding the Consumer’s complaint, where immediate investigation of the complaint is possible,

e. the signature of the person drawing up the record and – except in the case of an oral complaint made by telephone or by means of another electronic communications service – the signature of the Consumer,

f. the place and time at which the record was drawn up,

g. in the case of an oral complaint made by telephone or by means of another electronic communications service, the unique identification number of the complaint, and

h. a warning that if the Consumer does not provide the data set out in points a. and c. when the record is being drawn up, or refuses to sign the record, the Seller will not apply the reply requirements applicable to written complaints when dealing with the oral complaint

If, when communicating an oral complaint, the Consumer does not provide the data set out in points a) and c) above, or refuses to sign the record, the Business is not obliged to proceed in accordance with the reply requirements applicable to written complaints when dealing with the oral complaint.

The Seller shall – unless a directly applicable legal act of the European Union provides otherwise – reply to a written complaint on the merits in writing, in a verifiable manner, within thirty days of its receipt, and take steps to communicate that reply. The Seller shall give reasons for its position rejecting the complaint. Where the complaint is rejected, the Seller shall inform the Consumer in writing of which authority or conciliation board – depending on the nature of the complaint – the Consumer may initiate proceedings before. The information must also include the seat, telephone and internet contact details and postal address of the competent authority or of the Conciliation Board competent according to the Consumer’s place of residence, place of stay or registered seat, and whether the Seller has made a general declaration of submission.

If the Seller provides an electronic interface or form for submitting written complaints, it shall without delay confirm receipt of the written complaint to the e-mail address provided by the Consumer.

The Seller shall retain the record drawn up of an oral complaint or the written complaint, together with a copy of its substantive reply to the complaint, for three years, and shall present them to the supervisory authority upon request.

If any consumer dispute between the Seller and the Consumer is not settled through negotiation, the following legal remedies are available to the Consumer:

Consumer protection proceedings

Complaints may be lodged with the consumer protection authorities. If the Consumer perceives an infringement of their consumer rights, they are entitled to lodge a complaint with the consumer protection authority competent according to their place of residence. Following the assessment of the complaint, the authority shall decide whether to conduct consumer protection proceedings. First-instance consumer protection authority tasks are performed by the Budapest and county government offices competent according to the Consumer’s place of residence; their contact details are available here:

Court proceedings

The customer is entitled to enforce their claim arising from a consumer dispute before a court in civil proceedings, in accordance with the provisions of Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.

Conciliation Board proceedings

If we reject your consumer complaint, you are entitled to apply to the Conciliation Board competent according to your place of residence, place of stay or registered seat, or to the Conciliation Board designated by you in your application. A precondition for initiating Conciliation Board proceedings is that the Consumer has attempted to settle the dispute directly with the Business concerned.

The Conciliation Board – unless the Consumer requests a hearing in person – shall hold the hearing online, without personal presence, by means of an electronic device ensuring simultaneous transmission of sound and image (hereinafter: online hearing).

The Business is subject to an obligation to cooperate in the Conciliation Board proceedings, under which we are obliged to send our written reply to the Conciliation Board within the time limit upon its request. Except where Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC applies, the Business is obliged to ensure the attendance at the hearing of a person authorised to conclude a settlement. At the online hearing, the representative of the Business authorised to conclude a settlement is obliged to participate online. If the Consumer requests a hearing in person, the representative of the Business authorised to conclude a settlement is obliged to participate in the hearing at least online.

The Seller has not made a general declaration of submission to any conciliation board.

Partial invalidity, code of conduct

If any provision of the GTC is legally deficient or ineffective, the remaining provisions of the contract shall nonetheless remain in force, and the provisions of the relevant legislation shall apply in place of the ineffective or defective part.

Information on the essential characteristics of the Goods

On the Website, we provide information on the essential characteristics of the Goods available for purchase in the descriptions of the individual Goods.

Correction of data entry errors - Responsibility for the accuracy of the data provided

During the ordering process, before finalising the order, you have the opportunity at all times to modify the data you have entered (clicking the back button in the browser opens the previous page, so the entered data can be corrected even if you have already moved on to the next page). Please note that it is your responsibility to ensure that the data you provide are entered accurately, since the Goods will be invoiced and delivered on the basis of the data you provide. Please note that an incorrectly entered e-mail address or a full mailbox storage may result in the confirmation not being delivered and may prevent the Contract from being concluded. If the Buyer has finalised their order and discovers an error in the data provided, they must initiate the modification of their order as soon as possible. The Buyer may notify the Seller of the modification of an erroneous order by an e-mail sent from the e-mail address provided when placing the order, or by telephone.

Use of the Website

Purchasing does not require registration.

Selecting the Goods

You can select the desired product family (for example acoustic, marble-effect, stone-effect or decorative wall panels, accessories) from the Website menu or by clicking on the product categories, and within it the individual Goods. By clicking on the individual Goods, you will find photographs of the Goods, their description, technical data (dimensions, weight) and gross price per unit (for example HUF/panel, HUF/tube, HUF/length). For panel products, the price per square metre is also shown. For Goods with a colour choice (certain profiles), you can specify the colour in the “Colour” selector; the price of the selected colour is displayed. In the event of a purchase, you must pay the gross price shown next to the Goods on the Website, which includes 27% VAT. The delivery charge is payable in addition (see: Delivery service).

If a particular item of Goods cannot currently be ordered, this is indicated on the page of the Goods; in such a case the Goods cannot be added to the basket.

Adding to the basket

After selecting the Goods, you can set the quantity in the “Quantity” field using the “–” and “+” buttons, and then add the Goods to the basket by clicking the “Add to basket” button. Adding Goods to the basket does not constitute making an offer; accordingly, it does not give rise to any obligation on your part to purchase or to pay.

On the wall panel pages, in the “Recommended with this panel” section, you can also select accessories suited to the panel (adhesive, profiles). The adhesive is selected by default, in a quantity of 1 tube per panel; the selection can be removed at any time and the quantity can be changed. The profiles are not selected and are only added to the basket if you select them. Where accessories are selected, the button label becomes “Add to basket (N items)”, and with a single click the panel and the selected accessories are added to the basket together. Using the wall panel calculator button (“Add N panels to basket”), the calculated quantity can be added to the basket.

We recommend that you add the Goods to the basket even if you are not yet sure whether you wish to purchase them: in this way you can review and compare the selected Goods in one place. The contents of the basket may be freely modified until the order is submitted – that is, until the “Place order” button is pressed: you may remove Goods, add new ones and change the quantities.

When you add Goods to the basket, a basket overview opens on the right-hand side of the screen. Here you can see the Goods in the basket, their prices and the subtotal, as well as how much is still needed to qualify for free home delivery. If you do not wish to select further Goods, click the “Proceed to checkout” button. If you wish to continue shopping, click the “Continue shopping” button or close the overview.

Viewing the basket

By clicking the basket icon in the header of the Website, you can view the contents of the basket at any time, and the full summary on the “Basket” page. Here you can change the quantity of the Goods using the “–” and “+” buttons, and remove Goods from the basket using the “Remove” button. The system applies the change immediately and displays the updated prices and totals; you do not need to press a separate button for this. If the basket contains Goods that have in the meantime become unavailable for ordering, the system indicates this, and the purchase can be continued once those Goods have been removed.

If you do not wish to select further Goods, you can continue your purchase using the “Proceed to checkout” button.

Entering Customer details

On the “Checkout” page you can enter the details required for the order on a single page. On the same page, in the “Your order” summary, you can see throughout the contents of the basket, the delivery charge and the total amount payable.

  • Contact details: your name, e-mail address and – optionally – telephone number. If you have an account on the Website, you may log in, and your order will also appear in your account. You may also order without an account.

  • Method of receipt: you can choose between home delivery and personal collection in Budaörs. For home delivery, the system displays the delivery charge, which depends on the weight of the Goods and which you are obliged to pay if you place the order. Delivery is free above a specified product value. Personal collection is free of charge.

  • Delivery address: in the case of home delivery, you must provide the delivery address.

  • Billing address: by default, this is the same as the delivery address. If you would like the invoice to be issued to a different address, untick the box “My billing address is the same as my delivery address” and enter the billing details. If you require a company invoice, tick the box “I am buying as a company (company invoice)” and enter the company name and tax number.

  • Payment: you can choose the payment method (bank transfer on the basis of a pro forma invoice or – where available – payment by bank card).

  • Declarations: in order to submit the order, you must accept the privacy notice and the General Terms and Conditions. Both can be read by clicking the link next to the checkbox.

Reviewing and submitting the order

Before submitting the order, you can review on the “Checkout” page, in one place, all the details entered and the full summary of the order (Goods, quantities, delivery charge, the total amount and the VAT included therein). Any data entry errors can be corrected here at any time by overwriting the fields. You can modify the contents of the basket by clicking the “Edit basket” link.

By pressing the “Place order” button, you submit the order, which entails an obligation to pay. In the case of payment by bank card, the system then redirects you to the secure payment page of Teya; your card details do not reach us. After the order has been submitted, the order number and the order summary are displayed on the “Thank you for your order!” page. At the same time, we send a confirmation by e-mail to the e-mail address provided. In the case of bank transfer, the pro forma invoice is sent in a separate e-mail.

Finalising the order (making an offer)

Once you have satisfied yourself that the contents of the basket correspond to the Goods you wish to order and that your details are correct, you can complete your order by clicking the “Place order” button. The information published on the Website does not constitute an offer by the Seller to conclude a contract. In the case of orders falling within the scope of these GTC, you are deemed to be the offeror.

By pressing the “Place order” button, you expressly acknowledge that your offer is to be deemed to have been made and that your declaration – upon confirmation by the Seller in accordance with these GTC – entails an obligation to pay. The Seller is obliged to confirm receipt of your order to the Customer electronically without delay. If this confirmation does not reach the Customer within a reasonable period depending on the nature of the service, but no later than 48 hours from the submission of the Customer’s order, the Customer is released from the binding nature of the offer or from contractual obligation.

Processing of the order, conclusion of the contract

You may place an order at any time. The Seller confirms your offer by e-mail no later than 48 hours after your offer has been sent. The contract is concluded when the confirmation e-mail sent by the Seller becomes accessible to you in your e-mail system.

Payment methods

Cash payment

Pay on collection (only in the case of personal collection): in the case of personal collection, you may also pay the price of the Goods upon collection, at our shop in Budaörs, in cash or by bank card.

Bank transfer

You may also settle the consideration for the Goods by bank transfer. After the order, we send a pro forma invoice by e-mail. We fulfil the order after receipt of the Purchase Price: for home delivery, we dispatch it thereafter; for personal collection, we then notify you that it can be collected. The invoice is sent upon performance.

Teya

Payment by bank card on the secure payment page of Teya. Card details are handled by Teya and do not reach us. Following successful payment, we start processing the order immediately.

WF Direct

WF Direct is Woopla’s wall panel home delivery service, which covers the entire territory of Hungary.

We deliver the order to the address provided using our own delivery vehicle or a contracted courier partner; we choose the method of delivery based on the size of the order and the address, and this does not affect the delivery charge. Before delivery, we agree the time by telephone, so please provide a telephone number on which you can be reached during the day. Wall panels are large (up to 3 metres long) boards, so please ensure that the package can be received and placed at the place of receipt.

Upon receipt: please check that the package is intact in the presence of the carrier. If you see any damage to the packaging or the products, request that a damage report be drawn up, or refuse to accept the damaged package, and notify us at [email protected] or on +36 70 620 0432. Hidden defects are subject to the warranty and guarantee rules.

Weight Charge
0–90 kg 14 900 Ft
90–150 kg 19 900 Ft
over 150 kg 24 900 Ft

Delivery is free above a gross product value of 250 000 Ft.

5–7 working days from receipt of the Purchase Price in the case of bank transfer, or from successful payment in the case of payment by bank card.

Deadline for performance

In the case of a Buyer who qualifies as a consumer, unless otherwise agreed by the Parties, the Seller is obliged to make the Goods available to the Buyer without delay after the conclusion of the contract, but no later than within thirty days.

On the basis of the above, the general deadline for performance of the order is no more than 30 days from the confirmation of the order. The Seller provides information on any deadline for performance that may differ from this (but is not longer than 30 days) for each delivery method.

In the event of delay by the Seller, the Buyer is entitled to proceed against the Seller in accordance with Act V of 2013 on the Civil Code.

Reservation of rights, retention of title

If you have previously ordered Goods and did not accept them on delivery (excluding the case where you exercised your right of withdrawal), or the Goods were returned to the seller marked as not collected, the Seller will make performance of the order conditional upon advance payment of the Purchase Price and the delivery costs.

The Seller may withhold delivery of the Goods until it has satisfied itself that payment of the price of the Goods has been successfully made using the electronic payment solution (including the case where, for Goods paid for by bank transfer, the Buyer transfers the Purchase Price in the currency of its Member State and, as a result of the conversion and bank commissions and costs, the Seller does not receive the full amount of the Purchase Price and the delivery charge). If the price of the Goods has not been paid in full, the Seller may call upon the Buyer to pay the balance of the Purchase Price.

Sales abroad – prohibition of geo-blocking

The Seller does not distinguish, in the use of the Website, between customers within the territory of Hungary and those outside it within the territory of the European Union, i.e. it does not restrict customers’ access to the Website on the basis of their nationality, place of residence or place of establishment. Unless otherwise provided in these GTC, the Seller ensures the delivery/collection of the ordered Goods within the territory of Hungary.

The language of communication and of purchasing is primarily Hungarian; the Seller is not obliged to communicate with the customer in the language of the customer’s Member State.

The Seller is not obliged to comply with non-contractual requirements laid down in the national law of the customer’s Member State in relation to the Goods concerned, for example labelling or sector-specific requirements, or to inform the customer of such requirements.

Unless the Seller provides otherwise, it applies Hungarian VAT to all Goods.

For the purpose of handing over the Goods, the Seller also provides customers outside Hungary with the handover options available to Hungarian customers.

If, under the GTC, the customer may request delivery of the Goods to the territory of Hungary or to the territory of any other Member State of the European Union, a customer outside Hungary may also request this by any delivery method specified in the GTC.

If, under the GTC, the customer may choose personal collection of the Goods from the Seller, a customer outside Hungary may also avail themselves of this.

Otherwise, the customer may request to arrange delivery of the Goods abroad at its own expense. Hungarian customers are not entitled to this right.

The Seller fulfils the order after payment of the delivery charge; if the customer does not pay the delivery charge to the Seller or does not arrange its own delivery by the time agreed in advance, the Seller will terminate the contract and refund the Purchase Price paid in advance to the customer.

Consumer information

Information on the right of withdrawal of the consumer Buyer

Pursuant to point 3 of paragraph 1 of Section 8:1 of the Civil Code (Ptk.), only a natural person acting outside the scope of their profession, independent occupation or business activity qualifies as a consumer; accordingly, legal persons may not exercise the right of withdrawal without giving reasons!

Pursuant to Section 20 of Government Decree 45/2014 (II. 26.), the consumer is entitled to the right of withdrawal without giving reasons. The consumer may exercise their right of withdrawal

a) in the case of a contract for the sale of Goods
aa) of the Goods,
ab) in the case of the sale of several Goods, where the individual Goods are supplied at different times, of the Goods supplied last,
ac) in the case of goods consisting of several lots or pieces, of the lot or piece supplied last,
ad) where the goods are to be supplied regularly over a specified period, of the first supply,

within a period calculated from the day of receipt by the consumer or by a third party other than the carrier designated by the consumer, which period is 14 calendar days.

The provisions of this point do not affect the consumer’s right to exercise the right of withdrawal set out in this point also in the period between the day of conclusion of the contract and the day of receipt of the Goods.

If the consumer made the offer to conclude the contract, the consumer is entitled, before the conclusion of the contract, to withdraw the offer, which terminates the binding nature of the offer to conclude the contract.

If the Seller has not informed the consumer of the deadline and other conditions for exercising the right of withdrawal (in particular those set out in Section 22 of the Government Decree), and of the model statement set out in Annex 2, the withdrawal period described above is extended by 12 months. If, within 12 months of the expiry of the withdrawal period, the Seller has provided the consumer with the information relating to the exercise of the right of withdrawal, the period open for withdrawal or termination expires on the 14th day from the communication of that information.

Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses is available here.

Withdrawal statement, exercise of the consumer’s right of withdrawal or termination

The consumer may exercise the right granted by Section 20 of Government Decree 45/2014 (II. 26.) by means of an unequivocal statement to that effect, using the model statement that can also be downloaded from the Website, or by using the withdrawal function.

The withdrawal function

The withdrawal function is an online withdrawal statement in which the consumer can communicate to the business: their decision to withdraw from the contract, their name, details identifying the contract affected by the withdrawal, and the details of the electronic means through which the consumer will receive confirmation of the withdrawal.

The withdrawal function is accessible on the Website via the “Withdraw from contract” link. The consumer can send the online withdrawal statement to the Seller by using the confirmation function labelled “Confirm withdrawal”.

The Seller sends the consumer, without undue delay, an acknowledgement of receipt on a durable medium concerning its becoming aware of the withdrawal, which contains the content of the withdrawal and the date and time of its sending.

The online withdrawal function is available on the Website at the following location: https://woopla.eu/en/withdrawal.

Validity of the consumer’s withdrawal statement

The right of withdrawal shall be deemed to have been exercised in time if the consumer sends their statement within the deadline.

In the case of withdrawal or termination in writing, it is sufficient to send the withdrawal or termination statement within the deadline.

The burden of proving that the right of withdrawal was exercised in accordance with this provision lies with the consumer.

The Seller is obliged to confirm the consumer’s withdrawal statement on an electronic data medium after its receipt.

Obligations of the Seller in the event of withdrawal by the consumer

The Seller’s obligation to refund

If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller shall refund the full amount paid by the consumer as consideration, including the costs incurred in connection with performance, such as the delivery charge, no later than fourteen days from becoming aware of the withdrawal. Please note that this provision does not apply to additional costs caused by choosing a method of transport other than the least expensive standard method of transport.

Method of the Seller’s refund

In the event of withdrawal or termination in accordance with Section 22 of Government Decree 45/2014 (II. 26.), the Seller refunds the amount due to the consumer using the same payment method as used by the consumer. With the express consent of the consumer, the Seller may also use another payment method for the refund, but the consumer may not be charged any additional fee as a result. The Seller shall not be liable for any delay resulting from a bank account number or postal address provided incorrectly and/or inaccurately by the Consumer.

Additional costs

If the consumer expressly chooses a method of transport other than the least expensive standard method of transport, the Seller is not obliged to refund the resulting additional costs. In such a case, our refund obligation extends up to the amount of the general delivery charges indicated.

Right of retention

The Seller may withhold the amount due to the consumer until the consumer has returned the Goods or has proven beyond doubt that they have sent them back; whichever is earlier shall be taken into account. We are unable to accept consignments sent cash on delivery or with postage payable by the recipient.

Obligations of the Consumer in the event of withdrawal or termination

Return of the Goods

If the Consumer withdraws from the Contract in accordance with Section 22 of Government Decree 45/2014 (II.26.), the Consumer shall return the Goods without undue delay, and in any event no later than fourteen days from the communication of the withdrawal, or hand them over to the Seller or to a person authorised by the Seller to receive the Goods. The return shall be deemed completed in time if the Consumer sends the Goods before the deadline expires.

The Goods affected by the withdrawal must be returned to the following address:

Name of the Seller: WOOPLA ZRT

Return address: 2040 Budaörs Gyár utca 2

Bearing the direct costs of returning the Goods

The Consumer shall bear the direct cost of returning the Goods. The Goods must be returned to the address specified by the Seller above. Where the Seller also sells the Goods on business premises and the Consumer exercises the right of withdrawal in person at the Business’s premises, the Consumer is entitled to return the goods to the Business at the same time. If, after performance has begun, the Consumer terminates an off-premises or distance contract for the provision of services, the Consumer shall pay the Business a fee proportionate to the services performed up to the time the termination is communicated to the Business. The amount payable proportionately by the Consumer shall be determined on the basis of the total consideration stipulated in the Contract, including tax. If the Consumer proves that the total amount so determined is excessively high, the proportionate amount shall be calculated on the basis of the market value of the services performed up to the date on which the Contract terminated. Please note that we are unable to accept Goods returned cash on delivery or with postage due.

Consumer’s liability for diminished value

The Consumer shall be liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

Cases in which the right of withdrawal cannot be exercised

The Seller expressly draws your attention to the fact that you may not exercise your right of withdrawal in the cases set out in Section 29(1) of Government Decree 45/2014 (II.26.):

a. after the service has been fully performed; however, where the Contract imposes a payment obligation on the Consumer, this exception may only be relied upon if performance began with the Consumer’s express prior consent and the Consumer’s acknowledgement that the right of withdrawal will be lost once the Business has fully performed the Contract;

b. in respect of Goods or services whose price or fee depends on fluctuations in the financial market which cannot be influenced by the Business and which may occur within the period specified for exercising the right of withdrawal;

c. in the case of Goods that are not prefabricated and that were produced on the basis of the Consumer’s instructions or at the Consumer’s express request, or Goods that have been clearly personalised to the Consumer;

d. in respect of perishable Goods or Goods that retain their quality only for a short time;

e. in respect of sealed Goods which, for health protection or hygiene reasons, cannot be returned once unsealed after delivery (We draw your attention to the fact that, in respect of sealed goods which, for health protection or hygiene reasons, cannot be returned once unsealed after delivery, handling necessary to establish the nature, characteristics and functioning of the Goods results in the loss of the right of withdrawal.);

f. in respect of Goods which, by their nature, become inseparably mixed with other Goods after delivery;

g. in respect of alcoholic beverages whose actual value depends on market fluctuations which cannot be influenced by the Business, and whose price was agreed by the Parties at the time of concluding the sales contract, but which are delivered only after the thirtieth day following the conclusion of the contract;

h. in the case of a contract for work where the Business visits the Consumer at the Consumer’s express request in order to carry out urgent repair or maintenance work;

i. in respect of the sale of sealed audio or video recordings or copies of computer software, if the Consumer has unsealed the packaging after delivery;

j. in respect of newspapers, magazines and periodicals, with the exception of subscription contracts;

k. in the case of contracts concluded at public auctions;

l. in the case of a contract for the provision of accommodation other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities, if a specific date or period of performance has been stipulated in the Contract;

m. in respect of digital content not supplied on a tangible medium, if the Seller began performance with the Consumer’s express prior consent, and the Consumer, together with this consent, declared acknowledgement that the right of withdrawal will be lost once performance has begun, and the Business has sent a confirmation to the Consumer.

Information for consumer contracts on product warranty (termékszavatosság), warranty for material defects (kellékszavatosság) and guarantee (jótállás) relating to the conformity of goods

This section of the consumer information has been prepared under the authorisation of Section 11(5) of Government Decree 45/2014 (II.26.), taking into account Annex 3 to Government Decree 45/2014 (II.26.)

The Consumer information applies exclusively to Buyers qualifying as Consumers; the rules applicable to customers not qualifying as Consumers are set out in a separate chapter.

Requirements of conforming performance in the case of consumer contracts

General requirements of conforming performance for goods sold under a consumer contract

At the time of performance, the Goods and the performance must comply with the requirements laid down in Government Decree 373/2021 (VI.30.).

For performance to qualify as conforming, the Goods forming the subject of the Contract

  • must correspond to the description, quantity, quality and type set out in the Contract, and must have the functionality, compatibility, interoperability and other characteristics specified in the Contract

  • must be fit for any particular purpose specified by the Consumer which the Consumer made known to the Seller at the latest at the time of concluding the Contract and which the Seller accepted; must have all accessories and instructions for use specified in the Contract, including instructions on commissioning, installation instructions and customer support; and must be supplied with the updates specified in the Contract.

For performance to qualify as conforming, the Goods forming the subject of the Contract furthermore

  • must be fit for the purposes prescribed for Goods of the same type by legislation, technical standards or, in the absence of technical standards, the applicable code of conduct

  • must have the quantity, quality, performance and other characteristics, in particular with regard to durability, reparability, functionality, compatibility, accessibility, continuity and safety, that are usual for Goods of the same type and that the Consumer can reasonably expect, taking into account any public statement made by the Seller, its representative or any other person in the chain of sale regarding the specific characteristics of the Goods, in particular in advertising or on labelling; must have the accessories and instructions that the Consumer can reasonably expect, including packaging and instructions on commissioning; and

  • must correspond to the characteristics and description of Goods that the Business presented as a sample or model or made available as a trial version before the conclusion of the Contract.

The Goods need not conform to the above public statement if the Seller proves that

  • it was not aware, and could not reasonably have been aware, of the public statement

  • by the time of the conclusion of the Contract, the public statement had been corrected in an appropriate manner, or the public statement could not have influenced the entitled party’s decision to conclude the Contract.

Specific requirements of conforming performance for goods with digital elements

In the case of goods with digital elements, the Seller must ensure that the Consumer is notified of updates to the digital content of the goods or to the related digital service, including security updates, that are necessary to keep the goods in conformity, and must also ensure that the Consumer actually receives them.

The Seller must make the update available, where the sales contract

  • provides for a single act of supply of the digital content or digital service, for the period that the Consumer can reasonably expect given the type and purpose of the goods and the digital elements and taking into account the circumstances and nature of the contract; or

  • provides for continuous supply of the digital content over a period of time, then, in the case of continuous supply for a period not exceeding two years, for a period of two years from the delivery of the goods.

If the Consumer fails to install the updates made available within a reasonable time, the Seller shall not be liable for any defect in the goods that results solely from the lack of the relevant update, provided that

1. the Seller informed the Consumer of the availability of the update and of the consequences of the Consumer’s failure to install it; and

2. the Consumer’s failure to install the update or the Consumer’s incorrect installation of the update is not due to shortcomings in the installation instructions provided by the Seller.

There shall be no defective performance if, at the time of concluding the Contract, the Consumer was specifically informed that a particular characteristic of the goods deviated from those described here, and the Consumer expressly and separately accepted that deviation when concluding the sales contract.

Requirements of conforming performance for the sale of digital content under a consumer contract

The Seller supplies or provides the digital content to the Consumer. Unless the Parties agree otherwise, the Seller shall supply the digital content to the Consumer without undue delay after the conclusion of the Contract, in the most recent version available at the time of concluding the Contract.

The supply shall be deemed performed when the digital content, or any means suitable for accessing or downloading it, has been made available to the Consumer or to the physical or virtual facility chosen by the Consumer for that purpose.

The Seller must ensure that the Consumer is notified of updates to the digital content, including security updates, that are necessary to keep the digital content or digital service in conformity, and that the Consumer receives them.

Where, under the Contract, the digital content is supplied continuously over a specified period, the conformity of the performance in respect of the digital content must be ensured throughout the entire term of the Contract.

If the Consumer fails to install the updates made available by the Seller within a reasonable time, the Seller shall not be liable for any defect in the service that results solely from the lack of the relevant update, provided that

  • the Seller informed the Consumer of the availability of the update and of the consequences of the Consumer’s failure to install it; and

  • the Consumer’s failure to install the update or the Consumer’s incorrect installation of the update is not due to shortcomings in the installation instructions provided by the Seller.

There shall be no defective performance if, at the time of concluding the Contract, the Consumer was specifically informed that a particular characteristic of the digital content deviated from the requirements set out here, and the Consumer expressly and separately accepted that deviation when concluding the Contract.

The Seller performs defectively if a defect in the supply of the digital content results from its incorrect integration into the Consumer’s digital environment, provided that

  • the digital content was integrated by the Seller or under the Seller’s responsibility; or

  • the digital content was to be integrated by the Consumer, and the incorrect integration was caused by shortcomings in the integration instructions provided by the Seller.

Where the Contract provides for the continuous supply of the digital content or digital service over a specified period, the Seller shall be liable for any defect relating to the digital content that occurs or becomes apparent during the period specified in the Contract.

Where the Contract provides for a single act of supply or a series of individual acts of supply, it shall be presumed, until proven otherwise, that a defect which becomes apparent to the Consumer within one year from the time of performance already existed at the time of performance. However, the Seller does not perform defectively if it proves that the Consumer’s digital environment is not compatible with the technical requirements of the digital content or digital service, and it informed the Consumer of this in a clear and comprehensible manner before the conclusion of the Contract.

The Consumer shall cooperate with the Seller so that the Seller can ascertain, using the technically available means that are least intrusive for the Consumer, whether the cause of the defect lies in the Consumer’s digital environment. If the Consumer fails to comply with this obligation to cooperate after the Seller has informed the Consumer of it clearly and comprehensibly before the conclusion of the Contract, the burden of proving the following shall lie with the Consumer:

  • that a defect which became apparent within one year after performance already existed at the time of performance, or that the service affected by a defect which became apparent during the contractual period was not in conformity during the period of contractual performance of the service.

Defective performance of a contract for the sale of goods

The Seller performs defectively if a defect in the goods results from their incorrect commissioning, provided that

a) the commissioning forms part of the sales contract and was carried out by the Seller or under the Seller’s responsibility; or

b) the commissioning was to be carried out by the Consumer, and the incorrect commissioning is a consequence of shortcomings in the commissioning instructions provided by the Seller or, in the case of goods with digital elements, by the supplier of the digital content or digital service.

Where, under the sales contract, the goods are commissioned by the Seller or commissioning takes place under the Seller’s responsibility, performance shall be deemed completed by the Seller when the commissioning has been completed.

Where, in the case of goods with digital elements, the sales contract provides for the continuous supply of the digital content or digital service over a specified period, the Seller shall be liable for any defect in the goods relating to the digital content that occurs or becomes apparent within two years from the delivery of the goods in the case of continuous supply for a period not exceeding two years, or throughout the entire period of continuous supply in the case of continuous supply for a period exceeding two years.

Warranty for material defects (kellékszavatosság)

In what cases may you exercise your right under the warranty for material defects?

In the event of defective performance by the Seller, you may assert a warranty claim for material defects against the Seller in accordance with the rules of the Civil Code and, in the case of a consumer contract, Government Decree 373/2021 (VI.30.).

What rights are you entitled to on the basis of your warranty claim for material defects?

At your choice, you may assert the following warranty claims for material defects:

You may request repair or replacement, unless fulfilling the claim you have chosen is impossible or would entail disproportionate additional costs for the Seller compared with fulfilling another claim. If you did not or could not request repair or replacement, you may request a proportionate reduction of the consideration or, as a last resort, you may also withdraw from the contract.

Before bringing the Goods into conformity with the contract, the Seller shall inform the Consumer that, on the basis of the warranty claim for material defects, the Consumer may request repair or replacement at their choice, and that in the event of repair the limitation period of the warranty claim for material defects is extended once by twelve months.

Depending on the characteristics of the given product category, the Seller may lend replacement goods to the Consumer free of charge for the duration of the repair; the replacement goods may also be refurbished goods. The provision of replacement goods is not automatic; it may take place on the basis of a separate undertaking by the Seller.

At the express request of the Consumer, the Seller may also fulfil its obligation to replace the goods with refurbished goods.

You may also switch from the warranty right you have chosen to another one; however, you shall bear the cost of switching, unless it was justified or the Seller gave cause for it.

In the case of a consumer contract, until proven otherwise, it shall be presumed that a defect discovered within one year of the date of performance of the goods and of goods with digital elements already existed at the time of performance of the goods, unless this presumption is incompatible with the nature of the goods or the nature of the defect.

The Seller may refuse to bring the goods into conformity with the contract if repair or replacement is impossible, or if it would result in disproportionate additional costs for the Seller, taking into account all circumstances, including the value the Goods would have in a defect-free condition and the seriousness of the breach of contract.

The consumer is also entitled – in proportion to the seriousness of the breach of contract – to request a proportionate reduction of the consideration or to terminate the sales contract if

  • the Seller has not carried out the repair or replacement, or has carried it out but has failed, in part or in full, to meet the following conditions

  • the Seller must ensure, at its own expense, the taking back of the replaced goods; if the repair or replacement requires the removal of goods that were put into service in accordance with the nature and purpose of the goods – before the defect became discoverable – the obligation to repair or replace includes the removal of the non-conforming goods and the putting into service of the goods supplied as a replacement or repaired, or bearing the costs of the removal and putting into service.

  • the Seller has refused to bring the goods into conformity with the contract

  • a repeated defect in performance has occurred, despite the Seller having attempted to bring the goods into conformity with the contract

  • the defect in performance is so serious that it justifies an immediate price reduction or the immediate termination of the sales contract, or

  • the Seller has not undertaken to bring the goods into conformity with the contract, or it is evident from the circumstances that the business will not bring the goods into conformity with the contract within a reasonable time or without significant inconvenience to the consumer.

If the consumer wishes to terminate the sales contract on the grounds of defective performance, the burden of proving that the defect is insignificant lies with the Seller.

The Consumer is entitled to withhold the remaining part of the purchase price – in proportion to the seriousness of the breach of contract – in part or in full until the Seller fulfils its obligations relating to the conformity of performance and to defective performance.

As a general rule:

  • the Seller must ensure, at its own expense, the taking back of the replaced goods

  • if the repair or replacement requires the removal of goods that were put into service in accordance with the nature and purpose of the goods – before the defect became discoverable – the obligation to repair or replace includes the removal of the non-conforming goods and the putting into service of the goods supplied as a replacement or repaired, or bearing the costs of the removal and putting into service.

The reasonable time limit available for carrying out the repair or replacement of the Goods shall be calculated from the time at which the Consumer notified the business of the defect.

The consumer must make the Goods available to the business for the purpose of carrying out the repair or replacement.

The reduction of the consideration is proportionate if its amount equals the difference between the value of the goods to which the Consumer would have been entitled in the event of performance in conformity with the contract and the value of the goods actually received by the Consumer.

The Consumer’s warranty right for material defects to terminate the sales contract may be exercised by means of a legal statement addressed to the Seller expressing the decision to terminate.

If the defective performance affects only certain parts of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract are met in respect of those goods, the Consumer may terminate the sales contract only in respect of the defective goods, but may also terminate it in respect of any other goods acquired together with them if the Consumer cannot reasonably be expected to keep only the goods that conform to the contract.

If the Consumer terminates the sales contract in its entirety or in respect of part of the goods supplied under the sales contract,

  • the Consumer must return the goods concerned to the Seller at the Seller’s expense, and the Seller must, without delay, refund to the Consumer the purchase price paid for the goods concerned as soon as it has received the goods or proof of their return.

The Seller is obliged to draw up a record of the warranty claim notified to it by the consumer and to make a copy of it available to the consumer without delay, in a verifiable manner.

If the Seller, as a business, is unable to make a statement on whether the consumer’s warranty claim can be fulfilled at the time the claim is notified, it is obliged to inform the consumer of its position – and, in the event of the claim being rejected, of the reasons for the rejection and of the possibility of turning to the Conciliation Board – within 8 days, in a verifiable manner.

The Seller must endeavour to carry out the repair or replacement within a maximum of fifteen days. If the duration of the repair or replacement exceeds fifteen days, the Seller, as a business, is obliged to inform the consumer of the expected duration of the repair or replacement.

Within what time limit may you assert your warranty claim for material defects?

You are obliged to report the defect without delay after discovering it. A defect reported within two months of its discovery shall be deemed to have been reported without delay. However, please note that you can no longer assert your rights under the warranty for material defects after the two-year limitation period calculated from the performance of the contract.

If the Goods are brought into conformity with the contract by means of repair, the limitation period of the warranty claim for material defects is extended once by twelve months.

The part of the repair period during which the Buyer cannot use the Goods for their intended purpose shall not count towards the limitation period.

The limitation period of the warranty claim for material defects starts again in respect of the part of the Goods affected by the replacement or repair. This rule shall also apply where a new defect arises as a consequence of the repair.

Against whom may you assert your warranty claim for material defects?

You may assert your warranty claim for material defects against the Seller.

What other conditions apply to asserting your rights under the warranty for material defects?

Within one year of performance, there is no condition for asserting your warranty claim for material defects other than notifying the defect, provided that you prove that the Goods were supplied by the Seller. After one year from performance, however, you are obliged to prove that the defect you discovered already existed at the time of performance.

Special rules on warranty claims for material defects in the case of the supply of digital content

The consumer is also entitled – in proportion to the seriousness of the breach of contract – to request a proportionate reduction of the consideration or to terminate the contract for the supply of digital content if

a. repair or replacement is impossible, or would result in disproportionate additional costs for the Seller;

b. where the warranty right for material defects to repair or replacement is exercised, the Seller fails to bring the performance into conformity with the contract free of charge within a reasonable time from the consumer’s notification of the defect – without significant inconvenience to the consumer and taking into account the nature and purpose of the digital content or digital service;

c. a repeated defect in performance has occurred, despite the business having attempted to bring the goods into conformity with the contract;

d. the defect in performance is so serious that it justifies an immediate price reduction or the immediate termination of the contract; or

e. the Seller has not undertaken to bring the service into conformity with the contract, or it is evident from the circumstances that the business will not bring the service into conformity with the contract within a reasonable time or without significant inconvenience to the consumer.

Where the warranty right for material defects to repair or replacement is exercised, the Seller is obliged – without significant inconvenience to the consumer and taking into account the nature and purpose of the digital content or digital service – to bring the performance into conformity with the contract free of charge within a reasonable time from the consumer’s notification of the defect.

Where the warranty right for material defects to repair or replacement is exercised, the Seller may choose the method of bringing the digital content into conformity with the contract, depending on the technical characteristics of the digital content.

The reduction of the consideration is proportionate if its amount equals the difference between the value of the service to which the consumer would have been entitled in the event of performance in conformity with the contract and the value of the service actually provided to the consumer.

If the contract provides for a continuous service supplied over a specified period, the proportionate reduction of the consideration shall relate to the period during which the service was not in conformity with the contract.

If the consumer wishes to terminate the contract on the grounds of defective performance, the burden of proving that the defect is insignificant lies with the Seller.

If the Seller supplies or undertakes to supply digital content, and the consumer provides, or undertakes to provide, only personal data to the Seller, the consumer is entitled to terminate the contract even in the case of an insignificant defect, but may not request a proportionate reduction of the consideration.

The consumer’s warranty right for material defects to terminate the contract may be exercised by means of a legal statement addressed to the Seller expressing the decision to terminate.

If the Seller fails to perform, the consumer is obliged to call upon the Seller to perform. If, despite the consumer’s request, the Seller fails to supply or provide the digital content without delay or within an additional period agreed by the parties, the consumer may terminate the contract.

The consumer may terminate the contract without calling upon the Seller to perform if

  • the Seller has not undertaken to supply the digital content, or it is evident from the circumstances that it will not supply the digital content; or

  • it is evident from the agreement of the parties or from the circumstances of the conclusion of the contract that performance at a specified time is essential for the consumer, and the Seller fails to perform at that time.

In the event of termination of the contract, the Seller is obliged to refund the full amount paid by the consumer as consideration.

However, if the performance was in conformity with the contract for a certain period before the termination of the contract, the consideration due for that period need not be refunded. In the latter case, the part of the consideration relating to the period of non-conforming performance shall be refunded, together with any consideration paid in advance by the consumer which would have been due for the remaining term of the contract had it not been terminated.

If the consumer is entitled to a proportionate reduction of the consideration or to terminate the contract, the Seller is obliged to fulfil its refund obligation without delay, but no later than fourteen days from becoming aware of the exercise of this right.

The business shall refund the amount due to the consumer using the same means of payment as used by the consumer. With the express consent of the consumer, the Seller may also use another means of payment for the refund, but the consumer may not incur any additional fee as a result.

The costs relating to the refund shall be borne by the Seller.

In the event of termination of the contract, the Seller may prevent the consumer from continuing to use the digital content; in particular, it may make the digital content or digital service inaccessible to the consumer or disable the consumer’s user account.

In the event of termination of the contract, the consumer shall refrain from using the digital content and from making it available to third parties.

If the digital content was supplied on a physical data carrier, the consumer is obliged, at the request of the Seller communicated within fourteen days of becoming aware of the termination, to return the physical data carrier without delay at the Seller’s expense.

The consumer is obliged to pay a fee proportionate to the service performed in conformity with the contract for the use of the digital content during the period preceding the termination of the contract.

Product warranty (termékszavatosság)

In what cases may you exercise your right under the product warranty?

In the event of a defect in a movable item (Goods), you may – at your choice – assert either a warranty claim for material defects or a product warranty claim in accordance with the rules of the Civil Code.

What rights are you entitled to on the basis of your product warranty claim?

As a product warranty claim, you may request the repair or replacement of the defective Goods.

In what cases are the Goods considered defective?

The goods are defective if they do not meet the quality requirements in force at the time they were placed on the market, or if they do not have the properties set out in the description provided by the manufacturer.

Within what time limit may you assert your product warranty claim?

You may assert your product warranty claim within two years of the Goods being placed on the market by the manufacturer. After this period, you lose this entitlement.

Against whom may you assert your product warranty claim?

You may exercise your product warranty rights against the producer or distributor of the product (hereinafter together: the manufacturer).

What rule of proof applies when asserting a product warranty claim?

When asserting a product warranty claim, you must prove that the product defect existed at the time the product was placed on the market by the manufacturer.

In what cases is the manufacturer released from its product warranty obligation?

The manufacturer is released from its product warranty obligation if it can prove that:

  • it did not manufacture or place the Goods on the market in the course of its business activity, or the defect was not discoverable according to the state of science and technology at the time of placing on the market, or

  • the defect of the Goods results from the application of legislation or a mandatory regulatory requirement.

It is sufficient for the manufacturer to prove one ground in order to be released.

Please note that, on account of the same defect, you may assert a warranty claim for material defects against the business and a product warranty claim against the manufacturer at the same time, in parallel with each other. If your product warranty claim is successfully asserted, you may thereafter assert your warranty claim for material defects in respect of the replaced product, or the part of the product affected by the repair, only against the manufacturer.

Guarantee (jótállás)

In which cases may you exercise your right under the guarantee (jótállás)?

Pursuant to Government Decree 151/2003 (IX. 22.) on mandatory guarantees for certain durable consumer goods, the Seller is obliged to provide a guarantee (jótállás) when selling the new durable consumer goods listed in Annex 1 of Ministry of Justice Decree 10/2024 (VI.28.) on the determination of the range of durable consumer goods subject to mandatory guarantee (e.g. technical articles, tools, machines), as well as their accessories and components within the scope defined therein (hereinafter, in this section, together referred to as consumer goods).

The list of consumer goods subject to mandatory guarantee can be found here: Ministry of Justice Decree 10/2024 (VI. 28.) on the determination of the range of durable consumer goods subject to mandatory guarantee.

Rights arising from the guarantee may be enforced with a guarantee card or, as detailed in this section, with a document proving payment of the consideration. The Seller is not obliged to issue a guarantee card or hand it over to the consumer if the sale price of the consumer goods does not exceed HUF 100,000; in this case, rights arising from the guarantee may be enforced with a document proving payment of the consideration.

Irregular issuance of the guarantee card or failure to provide the guarantee card does not affect the validity of the guarantee.

If the guarantee card is not provided to the consumer, the conclusion of the contract shall be deemed proven if the consumer presents the document proving payment of the consideration – an invoice or receipt issued under the Act on Value Added Tax. In this case, rights arising from the guarantee may be enforced with the document proving payment of the consideration.

Fulfilment of a guarantee claim is not conditional upon the return of the opened packaging of the consumer goods.

What rights are you entitled to, and within what time limits, under a mandatory guarantee?

Guarantee rights

Under the guarantee, the Buyer may request repair or replacement, may request a price reduction in the cases provided for by law, or, as a last resort, may withdraw from the contract if the obligor has not undertaken repair or replacement, cannot fulfil this obligation within an appropriate time limit while sparing the interests of the entitled party, or if the entitled party’s interest in repair or replacement has ceased.

The Buyer may, at their choice, report the guarantee claim directly at the Seller’s registered office, any of its premises or branches, or at the repair service indicated by the Seller on the guarantee card.

Time limit for enforcement

A guarantee claim may be enforced during the guarantee period; under Government Decree 151/2003 (IX. 22.), the guarantee period is:

a. two years for a sale price of at least HUF 10,000 but not exceeding HUF 250,000,

b. three years for a sale price above HUF 250,000.

Failure to meet these time limits results in forfeiture of rights; however, in the event of repair of the consumer goods, the guarantee period is extended, from the day of handover for repair, by the period during which the Buyer could not use the consumer goods as intended due to the defect.

The guarantee period begins upon handover of the consumer goods to the Buyer or, if installation is carried out by the Seller, its agent or another person authorised to carry out installation, on the day of installation.

If the Buyer has the consumer goods installed more than six months after handover, the guarantee period begins on the day of handover of the consumer goods.

Rules on handling guarantee claims

The Seller shall endeavour to carry out repair or replacement within 15 days.

If the repair or replacement takes longer than fifteen days, the Seller is obliged to inform the Buyer of the expected duration of the repair or replacement. By accepting the General Terms and Conditions, the Buyer consents to this information being provided electronically or by any other means suitable for verifying receipt by the consumer.

If, in the event of a defect of the consumer goods during the guarantee period, the Seller establishes that the consumer goods cannot be repaired, the Seller is obliged, unless the customer provides otherwise, to replace the consumer goods within eight days. If replacement of the consumer goods is not possible, the business is obliged to refund to the consumer, within eight days, the purchase price indicated on the guarantee card or, in its absence, on the document presented by the consumer proving payment of the consideration for the consumer goods – an invoice or receipt issued under the Act on Value Added Tax.

If the Seller is unable to repair the consumer goods within 30 days:

If the consumer goods are not repaired by the thirtieth day following communication of the guarantee claim to the Seller, the Seller is obliged – unless the consumer provides otherwise – to replace the consumer goods within eight days following the unsuccessful expiry of the thirty-day time limit. If replacement of the consumer goods is not possible, the Seller is obliged to refund to the consumer the purchase price indicated on the guarantee card or, in its absence, on the document presented by the consumer proving payment of the consideration for the consumer goods – an invoice or receipt issued under the Act on Value Added Tax – within eight days following the unsuccessful expiry of the thirty-day repair time limit.

If the consumer goods become defective for the 4th time during the guarantee period - unless the consumer provides otherwise - the Seller is obliged to replace the consumer goods within eight days. If replacement of the consumer goods is not possible, the business is obliged to refund to the consumer, within eight days, the purchase price indicated on the guarantee card or, in its absence, on the document presented by the consumer proving payment of the consideration for the consumer goods - an invoice or receipt issued under the Act on Value Added Tax.

Consumer goods subject to mandatory guarantee that are permanently connected, weigh more than 10 kg, or cannot be carried as hand luggage on public transport - with the exception of vehicles - must be repaired at the place of operation. If the repair cannot be carried out at the place of operation, removal and reinstallation, as well as transport to and from the repair, shall be arranged by the business or - in the case of a repair claim enforced directly at the repair service - by the repair service.

The Seller is obliged to record the consumer’s guarantee claim reported to it in a written report and to provide a copy of it to the consumer without delay and in a verifiable manner.

If the Seller, as a business, cannot make a statement on the feasibility of the consumer’s guarantee claim at the time of reporting, it is obliged to notify the consumer of its position – and, in the event of rejection of the claim, of the reasons for rejection and of the possibility of turning to the Conciliation Board – within 8 days, in a verifiable manner.

Exceptions to the guarantee

The provisions set out under “Rules on handling guarantee claims” do not apply to electric bicycles, electric scooters, quad bikes, motorcycles, mopeds, passenger cars, motorhomes, caravans, trailer caravans, trailers or motorised watercraft.

However, in the case of these Goods, the Seller is also obliged to endeavour to fulfil the repair claim within 15 days.

If the repair or replacement takes longer than fifteen days, the Seller is obliged to inform the Buyer of the expected duration of the repair or replacement.

What is the relationship between the guarantee and other warranty rights?

The guarantee applies in addition to warranty rights (product warranty and warranty for material defects); the fundamental difference between general warranty rights and the guarantee is that, in the case of a guarantee, the burden of proof is more favourable to the consumer.

Replacement claim within three working days

In the case of sales through a webshop, the right to claim replacement within three working days also applies to new durable consumer goods. If the consumer enforces a replacement claim due to a defect of the consumer goods within 3 working days of purchase or installation, the Seller may not invoke disproportionate additional costs within the meaning of Section 6:159 (2) a) of Act V of 2013 on the Civil Code, and is obliged to replace the consumer goods within eight days, provided that the defect prevents use as intended. If replacement of the consumer goods is not possible, the Seller is obliged to refund to the consumer without delay the purchase price indicated on the guarantee card or, in its absence, on the document presented by the consumer proving payment of the consideration for the consumer goods – an invoice or receipt issued under the Act on Value Added Tax.

When is the Seller released from its guarantee obligation?

The Seller is released from its guarantee obligation only if it proves that the cause of the defect arose after performance.

Please note that, for the same defect, you may enforce a claim under the warranty for material defects (kellékszavatosság) and under the guarantee, as well as a claim under the product warranty (termékszavatosság) and under the guarantee, simultaneously and in parallel. However, if you have once successfully enforced your claim arising from defective performance for a given defect (for example, the business replaced the product), you may no longer make a claim on another legal basis in respect of the same defect.

Information on the product warranty, warranty for material defects and guarantee relating to the conformity of goods for Buyers who do not qualify as consumers

General rules on rights under the warranty for material defects

A Buyer who does not qualify as a consumer may – at their choice – make the following claims under the warranty for material defects:

You may request repair or replacement, unless fulfilling the claim you have chosen is impossible or would involve disproportionate additional costs for the Seller compared with fulfilling your other claim. If you have not requested, or could not request, repair or replacement, you may request a proportionate reduction of the consideration, or the Buyer may repair the defect, or have it repaired by another party, at the Seller’s expense, or – as a last resort – may withdraw from the contract.

You may switch from the warranty right you have chosen to another; however, you shall bear the cost of switching, unless it was justified or the Seller gave cause for it.

For customers who do not qualify as consumers, the time limit for enforcing rights under the warranty for material defects is 1 year, starting on the day of performance (handover).

Product warranty and guarantee

The product warranty and the mandatory guarantee are available only to customers who qualify as consumers and, subject to the conditions set out below, to micro, small and medium-sized enterprises.

If the manufacturer provides a manufacturer’s guarantee for the Goods that also extends to customers who do not qualify as consumers, it may be enforced directly with the manufacturer.

Special rules for micro, small and medium-sized enterprises

The provisions of this part apply exclusively to micro, small and medium-sized enterprises (hereinafter: SME) within the meaning of the Act on Small and Medium-sized Enterprises and the Support for their Development acting outside the scope of their trade, independent occupation or business activity.

Warranty for material defects for SMEs

Within what time limit may you enforce your claim under the warranty for material defects?

You are obliged to report the defect without delay after its discovery. A defect reported within two months of its discovery shall be deemed to have been reported without delay. However, please note that you may no longer enforce your rights under the warranty for material defects after the two-year limitation period from performance of the contract.

Against whom may you enforce your claim under the warranty for material defects?

You may enforce your claim under the warranty for material defects against the Seller.

What rights are you entitled to on the basis of your claim under the warranty for material defects?

You may – at your choice – make the following claims under the warranty for material defects:

You may request repair or replacement, unless fulfilling the claim you have chosen is impossible or would involve disproportionate additional costs for the Seller compared with fulfilling your other claim. If you have not requested, or could not request, repair or replacement, you may request a proportionate reduction of the consideration or – as a last resort – may withdraw from the contract.

Within 6 months of performance, there is no condition for enforcing your claim under the warranty for material defects other than reporting the defect, provided that you prove that the Goods were supplied by the Seller. After 6 months from performance, however, you are obliged to prove that the defect you identified already existed at the time of performance.

Product warranty for SMEs

In which cases may you exercise your right under the product warranty?

In the event of a defect in a movable item (Goods), you may – at your choice – enforce a claim under the warranty for material defects or a claim under the product warranty in accordance with the rules of the Civil Code.

What rights are you entitled to on the basis of your product warranty claim?

As a product warranty claim, you may request repair or replacement of the defective Goods.

Within what time limit may you enforce your product warranty claim?

You may enforce your product warranty claim within two years of the Goods being placed on the market by the manufacturer. After this time limit, you lose this entitlement.

Against whom may you enforce your product warranty claim?

You may exercise your product warranty rights against the producer or distributor of the product (hereinafter together: manufacturer).

In which cases is the manufacturer released from its product warranty obligation?

The manufacturer is released from its product warranty obligation if it can prove that:

  • it did not manufacture or place the Goods on the market in the course of its business activity, or the defect could not have been detected at the time of placing on the market according to the state of science and technology, or

  • the defect of the Goods results from the application of a law or a mandatory regulatory requirement.

It is sufficient for the manufacturer to prove one ground for release.

Guarantee for SMEs

In which cases may you, as an SME, exercise your right under the guarantee?

Pursuant to Government Decree 151/2003 (IX. 22.) on mandatory guarantees for certain durable consumer goods, the Seller is obliged to provide a guarantee when selling the new durable consumer goods listed in Annex 1 of Ministry of Justice Decree 10/2024 (VI.28.) on the determination of the range of durable consumer goods subject to mandatory guarantee (e.g. technical articles, tools, machines), as well as their accessories and components within the scope defined therein (hereinafter - in this section - together referred to as consumer goods), if you, as an SME, purchase the consumer goods acting outside the scope of your trade, independent occupation or business activity, in the course of a retail activity within the meaning of the Act on Trade, regardless of whether the consumer goods are accounted for within the scope of an economic activity.

When is the Seller released from its guarantee obligation?

The Seller is released from its guarantee obligation only if it proves that the cause of the defect arose after performance.
